DECISION
Application no . 32728/02 Sara FEDRIGON and O thers against Italy and 4 3 other applications (see list appended)
The European Court of Human Rights ( First Section ), sitting on 3 November 2016 as a Committee composed of:
Robert Spano , President, Pauliine Koskelo , Tim Eicke , judges, and Hasan Bakırcı , Deputy Section Registrar ,
Having regard to the above applications lodged on the dates indicated in the appended table ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
A list of the applicants is set out in the appendix.
The applicants ’ complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Italian Government (“the Government”) , who submitted observations on the admissibility and merits. The observations were forwarded to the applicant s, who were invited to submit their own observations.
By a letter sent to the applicants on 4 May 2016, the Registry requested an update on the status of the respective domestic proceedings.
No reply was received to the Registry ’ s letter s .
By a second letter sent to the applicants by registered post on 29 June 2016, the Registry indicated that no reply had been received to the letter of 4 May 2016 and requested the applicants to provide the updates referred to in its previous letter . The applicants ’ attention was drawn to Article 37 § 1 (a) of the Convention and to the fact that, in case of no reply, the Court might assume that the applicant s do not intend to pursue the application before the Court and strike their case out of its list of cases. The applicants received this letter on different dates . However, no answer has been received.
THE LAW
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
In the light of the foregoing, t he Court concludes that the applicant s may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application s .
Accordingly, the case s should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to join the applications;
Decides to strike the applications out of its list of cases.
