Having regard to the above application lodged on 25 February 2010,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Inna Grigoryevna Mochalova, a Russian national, was born in 1935 and lived in St Petersburg.

The Russian Government ("the Government") were represented initially by Mr G. Matyushkin, the Representative of the Russian Federation to the European Court of Human Rights, and then by his successor in that office, Mr M. Galperin.

The applicant complained under Article 8 of the Convention of a violation of her right to respect for her home.

On 19 September 2016 the Court decided to give notice to the Government of the applicant ’ s complaint detailed above.

On 23 December 2016 the Government informed the Registry that the applicant had died on 2 January 2013 and that they had not received any information as to the applicants ’ heirs. The Government asked the Court to strike the application out of its list of cases and terminate the proceedings.

On 16 January 2017 the Registry forwarded the Government ’ s observations to the applicant ’ s family and invited them to indicate whether there was a person who wished to pursue the proceedings before the Court in the present case. No heirs presented themselves to pursue the procedure.

THE LAW

In the light of the foregoing, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
