DECISION
Application no . 62676/11 MAGYAR HELSINKI BIZOTTSÁG against Hungary
The European Court of Human Rights (Fourth Section), sitting on 5 September 2017 as a Committee composed of:

Having regard to the above application lodged on 29 September 2011,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicant, Magyar Helsink i Bizottság , is a Hungarian non ‑ governmental organisation with its seat in Budapest. It was represented before the Court by Mr T. Fazekas , a lawyer practising in Budapest.
2. The Hungarian Government were represented by their Agent, Mr Z. Tallódi , of the Ministry of Justice.
3. The applicant complained under Article 10 of the Convention about the Hungarian authorities ’ reluctance to surrender certain information to which it was seeking access.
4. On 25 April 2017 the applicant organisation informed the Court that it wished to withdraw the application since its subject matter was virtually the same as in Magyar Helsinki Bizottság v. Hungary ([GC], no. 18030/11, ECHR 2016) in which a violation of Article 10 had already been found .
THE LAW
5. The Court notes that the applicant organisation does not intend to pursue the application within the meaning of Article 37 § 1 (a) of the Convention and considers that respect for human rights as defined in the Convention and its Protocols does not require it to continue the examination of the application under Article 37 § 1 in fine .
6. Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
