FIFTH SECTION
DECISION
Application no . 56006/11 GEORGIA RED CROSS SOCIETY against Georgia
The European Court of Human Rights (Fifth Section), sitting on 19 September 2017 as a Committee composed of:
Síofra O ’ Leary, President, Nona Tsotsoria , Lәtif Hüseynov, judges,
and Anne-Marie Dougin, Acting Deputy Section Registrar ,
Having regard to the above application lodged on 31 August 2011,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicant organisation, Georgia Red Cross Society, is a legal entity registered in Georgia.
2. The Georgian Government (“the Government”) were represented by their Agent, Mr B. Dzamashvili, of the Ministry of Justice.
3. The applicant organisation complained under Article 1 of Protocol No. 1 about the inability to have its real property recorded in the Land Register.
4. On 23 June 2017 the applicant organisation informed the Court that it wished to withdraw its application since, after the communication of the case on 30 May 2017, the matter giving rise to the complaint under Article 1 of Protocol No. 1 had been resolved at the domestic level.
THE LAW
5. In the light of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and its Protocols does not require it to continue the examination of the application under Article 37 § 1 in fine .
6. Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 12 October 2017 .
Anne-Marie Dougin Síofra O ’ Leary Acting Deputy Registrar President
