DECISION

Application no. 31953/07 Abdilkadir OTLUDERE against Turkey

The European Court of Human Rights (Second Section), sitting on 21 November 2017 as a Committee composed of:

Nebojša Vučinić, President, Valeriu Griţco, Jon Fridrik Kjølbro, judges,

and Hasan Bakırcı, Deputy Section Registrar ,

Having regard to the above application lodged on 23 July 2007,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Abdilkadir Otludere , is a Turkish national, who was born in 1955 and lives in St Chamond . He was represented before the Court by Ms E. Avondeaux -Vial, a lawyer practising in Lyon.

The Turkish Government (“the Government”) were represented by their Agent.

The applicant complained under Article 6 of the Convention that the Supreme Military Administrative Court could not be considered as an independent and impartial tribunal. He also argued under Article 13 of the Convention that there was no effective domestic remedy against the decisions of the Supreme Military Administrative Court.

On 28 July 2017 the Court gave notice to the Government of the applicant ’ s complaints detailed above and on the same day the applicant was informed by a letter.

On 30 August 2017 the applicant ’ s representative informed the Court that the applicant wanted to withdraw the application.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
