DECISION
Application no. 38473/03 Edith MINDL against Romania
The European Court of Human Rights (Fourth Section), sitting on 6 March 2018 as a Committee composed of:

Having regard to the above application lodged on 14 November 2003,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicant, Mrs Edith Mindl , is a German national, who was born in 1943 and lives in Nurnberg.
The Romanian Government (“the Government”) were represented by their Agent, Ms C. Brumar , from the Ministry of Foreign Affairs.
2. The applicant complained under Article 1 of Protocol No. 1 of the Convention about the application of the restitution laws in Romania.
3. On 8 June 2016 the applicant informed the Court that she wanted to withdraw the application since she found an alternative remedy for her complaint. The Registry ’ s letter of 24 June 2016, asking the applicant to confirm by 8 July 2016 her intention to withdraw her application, remained unanswered.
THE LAW
4. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, concludes that the applicant does not intend to pursue her application and that it is therefore appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
