Application no. 16945/16 Gheorghe TIMIȘ against Romania
The European Court of Human Rights (Fourth Section), sitting on 22 March 2018 as a Committee composed of:

Having regard to the above application lodged on 9 May 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Gheorghe TimiÈ™ , was born in 1987.
The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”) .
On 9 December 2016 the Registry sent a friendly settlement proposal to the parties which the Government accepted. However, since no acceptance of the proposal was received from the applicant, on 13 October 2017, the Registry informed the applicant that the Government had been invited to submit a unilateral declaration. The letter returned to the Court with the mention: “recipient deceased”.
On 1 February 2018 the Registry sent a letter to the applicant ’ s address asking whether there was a person who wished to pursue the proceedings on the deceased applicant ’ s behalf. The letter returned to the Court with the mention: “recipient deceased”.
THE LAW
In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
