DECISION

Application no. 46486/09 Andrey Viktorovich ANTONOV against Russia

The European Court of Human Rights (Third Section), sitting on 22 March 2018 as a Committee composed of:

Alena Poláčková, President, Dmitry Dedov, Jolien Schukking, judges, and Liv Tigerstedt, Acting Deputy Registrar,

Having regard to the above application lodged on 22 June 2009 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Andrey Viktorovich Antonov, was born in 1976.

The applicant ’ s complaints under Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention were communicated to the Russian Government (“the Government”) .

On 4 May 2017 the Government informed the Registry that applicant had died. By a letter dated 30 May 2017 the Registry invited the applicant ’ s heirs to inform whether they intend to pursue the application. No reply followed. In August 2017, in view of the lack of response from the applicant ’ s heirs, the Court informed the parties that it would proceed with the examination of the application on the basis of the case-file as it stood at the moment. No comments from the Government or the applicant ’ s heirs followed.

THE LAW

In the light of the foregoing, the Court concludes that the applicant ’ s heirs do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
