DECISION
Application no. 6030/16 Farhad FARYAB against Ukraine
The European Court of Human Rights (Fourth Section), sitting on 15 May 2018 as a Committee composed of:
Vincent A. De Gaetano, President, Georges Ravarani, Marko Bošnjak judges, and Andrea Tamietti, Deputy Section Registrar ,
Having regard to the above application lodged on 22 February 2016,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicant, Mr Farhad Faryab, is a British national, who was born in 1961 and is detained in Kharkiv.
2. The applicant ’ s complaints under Article 2 and 3 of the Convention about the poor conditions of his detention in the Kharkiv prison, the lack of adequate medical treatment and assistance while in detention and the conditions of his transportation from prison to the court hearings and back were communicated to the Ukrainian Government, who were represented by their Agent, Mr I. Lishchyna.
3. The applicant failed to appoint a representative despite having been requested twice by registered letters dated of 13 October and 7 December 2017 and received by him on 24 October and 26 December 2017 respectively, nor did he seek leave to present his own case. His attention was drawn to Article 37 § 1 (a) of the Convention.
THE LAW
4. The Court considers that, in the circumstances described above, the applicant may be regarded as no longer wishing to pursue his application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.
5. In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
