DECISION

Application no. 41988/13 Miro ĆALUŠIĆ against Croatia

The European Court of Human Rights (First Section), sitting on 22 May 2018 as a Committee composed of:

Aleš Pejchal, President, Armen Harutyunyan, Jovan Ilievski, judges,

and Renata Degener, Deputy Section Registrar ,

Having regard to the above application lodged on 18 June 2013,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. The applicant, Mr Miro Ćalušić, a Croatian national, born in 1978, lived in Zagreb. He was represented before the Court by Ms V. Drenški Lasan, a lawyer practising in Zagreb.

2. The Croatian Government (“the Government”) were represented by their Agent, Ms Å . Sta ž nik.

3. The applicant complained under Article 6 § 2 of the Convention that the Zagreb Municipal Criminal Court had breached his right to the presumption of innocence when extending his pre-trial detention.

4. On 8 October 2015 the Court decided to give notice to the Government of the applicant ’ s complaint detailed above.

5. On 8 February 2016 the Government submitted to the Registry their observations on the admissibility and merits of the application. These were forwarded on 9 February 2016 to the applicant, who was invited to submit observations in reply by 22 March 2016. On 9 March 2016 the applicant submitted his reply to the Government ’ s observations.

6. On 28 March 2018 the death of the applicant was communicated to the Registry. No heirs presented themselves to pursue the procedure.

THE LAW

7. In the light of the foregoing, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
