Having regard to the above applications lodged on 27 July 2016 and 20 January 2017 respectively ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The case originated in two applications (nos. 45302/16 and 11061/17) lodged by Russian nationals Mr Nikita Nikolayevich Ostapko , born in 1989, and Mr Dmitriy Vasilyevich Manyuk , born in 1968.
The applicants ’ complaints under Article 3 of the Convention, concerning the inadequate conditions of their detention, and in application no. 45302/16 also a complaint under Article 13 concerning lack of any effective remedy in respect of inadequate conditions of detention, were communicated to the Russian Government (“the Government”) .
On 9 November 2016 Mr Ostapko , and on 10 September 2017 Mr Manyuk , informed the Registry that they wanted to withdraw their applications before the Court.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the applications.
Accordingly, the applications should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to join the applications and to strike them out of its list of cases.
