FIFTH SECTION
DECISION
Application no. 42015/10 Tatyana Vasilyevna PODZOROVA and Igor Yulyevich PODZOROV against Ukraine
The European Court of Human Rights (Fifth Section), sitting on 26 June 2018 as a Committee composed of:
Erik Møse , President, Síofra O ’ Leary, Lәtif Hüseynov , judges, a nd Claudia Westerdiek , Section Registrar ,
Having regard to the above application lodged on 8 July 2010,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicants, Ms Tatyana Vasilyevna Podzorova and Mr Igor Yulyevich Podzorov , are Ukrainian nationals, who were born in 1950 and 1972 respectively and live in Kharkiv .
2. The applicants ’ complaints under Article 6 § 1 of the Convention about the failure of the domestic courts to examine the merits of their respective claims, which allegedly deprived them of their right of access to court, were communicated to the Ukrainian Government (“the Government”), who were represented by their Agent, Mr I. Lishchyna .
3. The applicants failed to respond to the Registry ’ s letter of 23 March 2018 (received on 11 April 2018), reminding them that the period allowed for appointing a representative had expired and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention.
THE LAW
4. The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 19 July 2018 .
