DECISION
Application no. 56966/09 Stelian ŞTEFĂNESCU against Romania and 18 other applications (see appended table)
The European Court of Human Rights (Fourth Section), sitting on 5 July 2018 as a Committee composed of:

Having regard to the above application s lodged on the various dates indicated in the appended table,
Having regard to the observations submitted by the respondent Government and the observations in reply submitted by the applicant s ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The list of applicants is set out in the appended table.
2. The applicants ’ complaints under Article 6 § 1 of the Convention and Article 1 of the Protocol No. 1 concerning the non-enforcement or delayed enforcement of domestic judgments were communicated to the Romanian Government (“the Government”) . In application no. 56966/09 the applicant also raised other complaints under the provisions of the Convention.
THE LAW
A. Joinder of the applications
3. Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
B. Complaints under Article 6 § 1 of the Convention and Article 1 of the Protocol No. 1 ( non-enforcement or delayed enforcement of domestic judgments)
1. Preliminary issues
4 . As concerns application no. 75623/13 the Government raised a preliminary objection, arguing that the application should be dismissed as incompatible ratione personae. In this connection the Government submitted that the judgment in the applicant ’ s favor was enforced within a period of 3 years and 7 months. The domestic courts awarded the applicant compensation for the delayed enforcement of the said judgment.
5. The applicant did not bring any arguments capable of disproving these facts.

Comparing the compensation granted at domestic level in the present case with the amounts awarded by the Court for comparable delayed enforcement of domestic judgments in similar cases (see Trofim v. Romania (just satisfaction), no. 1193/08 , § 15, 3 March 2015) , the Court considers that the amount awarded to the applicant cannot be regarded as unreasonable.
7 . In the light of the above, the Court finds that the national authorities have acknowledged and then afforded redress for the alleged breach of the Convention. It follows that the applicant can no longer claim to be the victim of a violation of the Convention within the meaning of Article 34 (see Shikunov v. Russia (dec.), no. 23211/04, § 18, 23 January 2018), that the Government ’ s objection must be upheld and that this application is to be rejected pursuant to Articles 34 and 35 §§ 3 (a) and 4.

In respect of applications nos. 61627/14 and 34904/15, the Government submitted that the complaints of some of the applicants, namely Mr Cristian Ștefănescu Zamfir (application no. 61627/14), Mr Niculae Apostol and Mr Grigore Banu (application no. 34904/15) should be dismissed as incompatible ratione personae . In this connection the Government pointed out that these applicants were not parties in the domestic proceedings and could not, therefore, claim to be victims of the alleged violations of the Convention.
9. The applicants did not address this preliminary objection.

In light of all the evidence before it, and in particular noting that Mr Cristian Ștefănescu Zamfir, Mr Niculae Apostol and Mr Grigore Banu were not parties in the domestic proceedings, the Court considers that the Government ’ s objection as regards these applicants ’ lack of legal standing must be upheld. It follows that applications nos. 61627/14 and 34904/15 are incompatible ratione personae with the provisions of the Convention in respect of the three aforementioned applicants, within the meaning of Article 35 § 3 (a) and must be rejected in accordance with Article 35 § 4 of the Convention (see Yavorovenko and Others v. Ukraine , no. 25663/02, §§ 19-21, 17 July 2014).
11. T he Court finds that it does not need to rule on the rest of the preliminary objections raised by the Government, because the complaints in the remaining applications are inadmissible in any event, as presented below.
2. Remaining applications
12. Having examined all the material before it, the Court considers that, for the reasons stated below, the respondent Government cannot be held liable for the non-enforcement or the delayed enforcement of the judgments given in the applicants ’ favour in the remaining applications.

In respect of applications nos. 61627/14, 34904/15, 16114/16, 29599/16 and 29629/16 the Court notes that on 6 December 2013 the debtor company was declared bankrupt and the Brăila County Court duly acknowledged the “objective impossibility” to enforce the outstanding judgment. Therefore, the applicants had become aware that there was no realistic hope of a favourable outcome or progress of the enforcement proceedings at the domestic level on 6 December 2013, more than six months before they lodged their applications with the Court (see Sokolov and Others v. Serbia (dec.), no. 30859/10, § 29, 14 January 2014). It follows that these applications were submitted too late and they must be rejected in accordance with Article 35 §§ 1 and 4 of the Convention.
14 . In respect of applications nos. 56966/09 and 2113/14 the Court notes the existence of an objective impossibility of enforcing the judgments in the applicants ’ favour (see Ciobanu and Others v. Romania (dec.), nos. 898/06 and 3 others, § 27, 6 September 2011).
15. In applications nos. 64930/14, 77000/14, 9404/15 and 14110/15, t he Court notes that the judgments in question were enforced within periods ranging from 1 month to 3 years and 7 months. However, taking into account the complexity of the enforcement proceedings, the conduct of the applicants as well as the conduct of the authorities, the Court notes that these periods are not so excessive as to raise an arguable claim under the Convention (see, for example, Ş erb ă nescu v. Romania (dec.), no. 43638/10, §§ 9-10, 1 December 2016).

In application no. 68755/14, having regard to the particular context of the case, namely the amount to be paid and the domestic authorities ’ assessment as to the impact of an immediate payment of the total amount, the Court considers that the measures taken by the national authorities to pay the amount due in several instalments struck a fair balance between the applicant ’ s rights to see the judgment enforced within a reasonable time and the public interest at stake (see Dumitru and Others v. Romania (dec.), no. 57265/08, §§ 45-52, 4 September 2012).

In applications nos. 54153/14, 54323/14, 60172/14 and 62295/14, in light of the particular circumstances of these cases, namely the high number of creditors and that the applicants are privileged creditors registered on the creditors ’ list in liquidation proceedings which are pending, with the possibility still remaining to recover their debt, the Court finds that the enforcement delays are justified and that they are not so excessive as to raise an arguable claim under the Convention (see Mur ă rașu v. Romania (dec.), no. 45733/10, § 33, 10 November 2015).

As regards applications nos. 3498/15 and 17627/15 the Court notes that the applicants did not undertake the required procedural steps in order to enforce the judgments, failing to demolish the private persons ’ constructions at their expense (application no. 3498/15) and to file a timely request to register on the creditors ’ list (application no. 17627/15) (see Li v. Russia, no. 38388/07, §§ 14-21, 24 April 2014).
19. In view of the above, the Court finds that the complaints as described in paragraphs 14 - 18 above are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention.
C. Remaining complaints
20. In application no. 56966/09 the applicant also raised other complaints under various articles of the Convention.
21. The Court has examined the complaints and considers that, in the light of all the material in its possession and in so far as the matters complained of are within its competence, these complaints do not meet the admissibility criteria set out in Articles 34 and 35 of the Convention.
22. It follows that these complaints must be rejected in accordance with Article 35 § 4 of the Convention .
For these reasons, the Court, unanimously,
Decides to join the applications;
Declares the application s inadmissible.
