Application no. 14642/18 Malgorzata SUMISLAWSKA and Helena ZAJIC against the United Kingdom

Having regard to the above application lodged on 27 March 2018,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicants, Ms Malgorzata Sumislawska and Ms Helena Zajic , are Polish nationals, who were born in 1985 and 2016 respectively and lived in Å» ary , Poland, but are now living in Coventry, the United Kingdom, as of 1 June 2018.
The applicants complained under Article 8 of the Convention about the decision of the domestic court to order their return to the United Kingdom from Poland following Hague Convention and wardship proceedings initiated by the second applicant ’ s father, a Czech national residing in the United Kingdom. The applicants complained the decision violated their right to private and family life.
On 19 July 2018 the applicants informed the Court that they wanted to withdraw the application further to their voluntary return to the United Kingdom and engagement in domestic High Court proceedings regarding the residence and contact arrangements of the second applicant.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
