Application no. 45128/13 ALSYS DATA HUNGARY KFT against Hungary
The European Court of Human Rights (Fourth Section), sitting on 27 September 2018 as a Committee composed of:
Georges Ravarani , President, Marko Bošnjak , Péter Paczolay , judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 10 July 2013 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Alsys Data Hungary Kft , was a limited liability company with its seat in Budapest.
The applicant company ’ s complaint under Article 6 § 1 and 13 of the Convention concerning the excessive length of civil proceedings was communicated to the Hungarian Government (“the Government”) on 7 December 2017 . The Government ’ s declaration accepting a friendly settlement was received by the Court on 3 May 2018. No correspondence has been received from the applicant company in response to the Court ’ s correspondence or the Government ’ s declaration.
Meanwhile, the Court was informed of the demise of the applicant company ’ s legal representative on 24 April 2014. The applicant company did not appoint another legal representative. Further, according to publicly available official records, the applicant company had gone into liquidation, been dissolved and deleted from the companies ’ register as of 25 July 2015.
THE LAW
In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
