Application no. 46720/16 Sergiu MARIAN against Romania
The European Court of Human Rights (Fourth Section), sitting on 11 October 2018 as a Committee composed of:

Having regard to the above application lodged on 22 September 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Sergiu Marian, was born in 1970.
The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”) .
On 31 August 2018 the applicant informed the Registry that he wanted to withdraw the application to the Court since he intended to pursue the compensatory remedy provided by Law 169/2017.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
