DECISION
Application no. 76185/13 Alfréd JÓNÁS against Hungary and 26 other applications (see appended table)
The European Court of Human Rights (Fourth Section), sitting on 11 October 2018 as a Committee composed of:

Having regard to the above application s lodged on the various dates indicated in the appended table,
Having regard to the observations submitted by the respondent Government and the observations in reply submitted by the applicant s ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The list of applicant s is set out in the appended table.
The applicants ’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Hungarian Government (“the Government”) . Some of the applicants also raised a complaint under Article 13 of the Convention concerning the lack of effective remedy in domestic law in respect of their poor conditions of detention.
THE LAW
A. Joinder of the applications
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
B. Complaints under Articles 3 and 13 of the Convention
In the present application s , having examined all the material before it, the Court considers that for the reasons stated below, these complaints are inadmissible.
In particular, the Court notes that the newly introduced domestic remedy in respect of inadequate conditions of detention in Hungary was held to be an effective one in the case of Domján v. Hungary ((dec.), no. 5433/17, 14 November 2017). This remedy was available to the applicants and, indeed, used by them. Thus, the Court notes that the first instance courts, applying the compensation scale contemplated in the Domján decision, awarded monetary compensation to the applicants for the days spent in inadequate conditions in detention (see the appended table below). The applicants did not appeal against those decisions to the appellate courts.
It follows that domestic remedies were available to the applicants but that they failed to exhaust them. The applications must therefore be rejected, pursuant to Article 35 §§ 1, 3 (a) and 4 of the Convention.
For these reasons, the Court, unanimously,
Decides to join the applications;
Declares the application s inadmissible.
