DECISION
Application no. 46670/15 Roland KOVÁTS against Hungary
The European Court of Human Rights (Fourth Section), sitting on 29 November 2018 as a Committee composed of:
Georges Ravarani, President, Marko Bošnjak, Péter Paczolay, judges, and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 16 September 2015 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Roland Kováts, was born in 1982.
The applicant ’ s complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings and under Article 13 concerning the absence of an effective remedy were communicated to the Hungarian Government (“the Government”) .
The Registry ’ s letter dated 29 March 2018 informing the applicant about the communication of the case to the Government was returned by the post with the notice that the applicant had moved away from the address known to the Court. A further letter was sent to the applicant by registered mail on 19 September 2018. This was likewise returned by the post with the notice that the applicant was no longer known at that address.
The applicant has not informed the Registry of any new address. Indeed, no communication has reached the Court from the applicant ’ s side since September 2015.
THE LAW
In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
