DECISION

Application no. 8475/18 Pavel Viktorovich KOTLYARENKO against Russia

The European Court of Human Rights (Third Section), sitting on 1 1 December 2018 as a Committee composed of:

Helen Keller, President, Pere Pastor Vilanova, María Elósegui, judges,

and Fatoş Aracı, Deputy Section Registrar ,

Having regard to the above application lodged on 29 December 2017,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Pavel Viktorovich Kotlyarenko, is a Russian national, who was born in 1974 and lives in Velikiy Novgorod. He was represented before the Court by Mr P. Muzny and Mr S.H. Brady, lawyers practising in Geneva and Strasbourg.

The applicant ’ s complaints under Articles 9 and 14 of the Convention were communicated to the Russian Government, who were represented by Mr M. Galperin, the Representative of the Russian Federation to the European Court of Human Rights.

On 30 July 2018 the Government submitted their observations on the admissibility and merits of the application. These were forwarded to the applicant, who was invited to submit observations in reply by 4 October 2018.

On 3 October 2018 the applicant ’ s representative informed the Court that the applicant wanted to withdraw the application and requested to strike the application out of its list of cases.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
