Application no. 72415/10 Stefcho Hristov MINCHEV and Stoyanka Borisova KUMPIKOVA-MINCHEVA against Turkey

The European Court of Human Rights (Second Section), sitting on 7 March 2019 as a Committee composed of:

Stéphanie Mourou -Vikström, President, Arnfinn Bårdsen , Darian Pavli , judges ,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 17 November 2010 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants, Mr Stefcho Hristov Minchev and Mrs Stoyanka Borisova Kumpikova-Mincheva , are Bulgarian nationals who were born respectively in 1952 and 1941. They live in Varna (Bulgaria).

The applicants ’ complaints under Articles 2 and 13 of the Convention concerning the Turkish Government ’ s failure to respect and protect their son ’ s right to life and the absence of effective remedies in that respect were communicated to the Turkish Government (“the Government”) .

On 30 September 2018 the applicants informed the Registry that they wanted to withdraw the application to the Court. The Government did not object to the applicants ’ request.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
