Application no. 31068/12 Anna Gennadyevna PASTUKHOVA-GLEBOVA and Lidiya Vladimirovna GLEBOVA against Russia

The European Court of Human Rights (Third Section), sitting on 18 June 2019 as a Committee composed of:

Having regard to the above application lodged on 2 May 2012,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants, Ms Anna Gennadyevna Pastukhova-Glebova and Ms Lidiya Vladimirovna Glebova , are Russian nationals, who were born in 1974 and 1948 respectively and live in Yekaterinburg .

The applicants ’ complaints concerning alleged failure of the authorities to assist them in the enforcement of a judgement against a private party were communicated to the Russian Government (“the Government”), who were represented by Mr M. Galperin , the Representative of the Russian Federation to the European Court of Human Rights.

The applicants failed to respond to the Registry ’ s last letter of 21 January 2019 (received by them on 3 March 2019), reminding them that the period allowed for submission of their reply to the Government ’ s observations had expired on 14 September 2018 and that no extension of time had been requested. They attention was drawn to Article 37 § 1 (a) of the Convention.

THE LAW

The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
