FOURTH SECTION
DECISION
Application no. 28190/18 A.A. and Others against the Netherlands
The European Court of Human Rights (Fourth Section), sitting on 29 August 2019 as a Committee composed of:
Stéphanie Mourou-Vikström, President, Georges Ravarani, Jolien Schukking, judges, and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 18 June 2018 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicants, a couple and their two minor children, are Libyan nationals and hail from Tripoli. They were represented by Ms E.C. Kaptein, a lawyer practising in Amsterdam.
The applicants ’ complaint under Article 3 of the Convention concerning their removal to Libya was communicated to the Dutch Government (“the Government”).
On 27 May 2019 the applicants informed the Registry that they wanted to withdraw the application to the Court as they had been granted a residence permit.
THE LAW
In the light of the foregoing, t he Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 19 September 2019 .
