DECISION

Application no. 58012/10 A.S . against Poland

The European Court of Human Rights (First Section), sitting on 22 October 2019 as a Committee composed of:

Armen Harutyunyan , President, Krzysztof Wojtyczek , Pere Pastor Vilanova , judges, and Renata Degener, Deputy Section Registrar ,

Having regard to the above application lodged on 4 October 2010,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms A. S., is a Polish national, who was born in 1975 and lives in Zgierz. The President granted the applicant ’ s request for her identity not to be disclosed to the public (Rule 47 § 4).

The Polish Government (“the Government”) were represented by their Agent Mr J. Sobczak of the Ministry of Foreign Affairs.

The applicant complained under Article 14 read in conjunction with Article 8 of the Convention that she had been refused custody of her children on the grounds of her sexual orientation.

On 26 February 2019 the Court decided to give notice to the Government of the applicant ’ s complaints detailed above.

On 17 July 2019 the applicant informed the Court that she wanted to withdraw the application.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
