Application no. 31235/16 Tamila Dmytrivna PALENCHUK against Ukraine
The European Court of Human Rights (Fifth Section), sitting on 14 November 2019 as a Committee composed of:
Gabriele Kucsko-Stadlmayer, President, Mārtiņš Mits, Lәtif Hüseynov, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 26 May 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms Tamila Dmytrivna Palenchuk, was born in 1978.
The applicant was represented by Mr S.V. Papernyk, a lawyer practising in Kyiv.
The applicant ’ s complaint under Article 6 § 1 of the Convention concerning the alleged denial of access to justice in an employment dispute was communicated to the Ukrainian Government (“the Government”).
By letter dated 13 August 2019, and received by the Court on 26 September 2019, the applicant informed the Registry that she wanted to withdraw her application to the Court since she no longer had any intention to pursue it.
THE LAW
In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
