FOURTH SECTION
DECISION
Application no. 65532/16 József KERTÉSZ against Hungary
The European Court of Human Rights (Fourth Section), sitting on 16 January 2020 as a Committee composed of:
Stéphanie Mourou-Vikström, President, Georges Ravarani, Jolien Schukking, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 9 November 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr József Kertész, was born in 1971.
The applicant was represented by Ms E. Kadlót, a lawyer practising in Budapest.
The applicant ’ s complaints under Article s 3 and 6 of the Convention concerning his life sentence were communicated to the Hungarian Government (“the Government”).
On 28 October 2019 the applicant ’ s representative informed the Registry that applicant had died. She did not specify that the application to the Court would be pursued by any heir.
THE LAW
In the light of the foregoing, the Court concludes that the applicant ’ s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 6 February 2020 .
