DECISION

Application no. 14443/19 Aycan KAYA and O thers against Turkey

The European Court of Human Rights (Second Section), sitting on 11 February 2020 as a Committee composed of:

Valeriu Griţco , President, Arnfinn Bårdsen , Peeter Roosma , judges,

and Hasan Bakırcı, Deputy Section Registrar ,

Having regard to the above application lodged on 25 March 2019,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1 . A list of the applicants is set out in the appendix.

2 . The Turkish Government (“the Government”) were represented by their Agent.

3 . The application concerned the alleged disappearance of Mr Özgür Kaya, the applicants ’ relative, following his alleged abduction by unknown persons on 13 February 2019 and the alleged lack of an effective investigation into his disappearance.

4 . On 9 April 2019 the Court decided to give notice to the Government of the applicants ’ complaints raised under Articles 2, 3 and 5 of the Convention.

5 . On 16 December 2019 the applicants informed the Court that the applicants wanted to withdraw the application since Mr Kaya was found on 28 July 2019 and stated that he had not been abducted, as alleged.

THE LAW

6 . The Court takes note of the wish expressed by the applicants to withdraw the application. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

7 . In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
