DECISION
Application no. 54733/16 Victor-Gabriel ROTARU against Romania
The European Court of Human Rights (Fourth Section), sitting on 28 May 2020 as a Committee composed of:

Having regard to the above application lodged on 4 October 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Victor-Gabriel Rotaru , was born in 1983.
The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”)
On 22 May 2019 the Government informed the Registry that the applicant had died.
On 2 January 2020, the Registry sent a letter, by registered post, to the applicant ’ s address asking whether there was any potential heir wishing to pursue the proceedings before the Court.
On 6 February 2020 the letter was returned to the Court with the mention “unclaimed”.
There is no previous letter from the applicant informing the Court about a change of address and no relative has contacted the Court regarding the application.
THE LAW
In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
