Application no. 36253/13 R.L . against Russia

The European Court of Human Rights (Third Section), sitting on 11 June 2020 as a Committee composed of:

Alena Poláčková , President, Dmitry Dedov , Gilberto Felici , judges,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 25 May 2013 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr R.L., was born in 1983. The Court decided that the applicant ’ s name should not be disclosed to the public (Rule 47 § 4 of the Rules of Court).

The applicant was represented by Ms T. Glushkova , a lawyer practising in Moscow.

The applicant ’ s complaints under Articles 8 and 14 of the Convention concerning the lack of legal recognition of his gender transition were communicated to the Russian Government (“the Government”) , who submitted observations on the admissibility and merits.

On 29 January 2020 the Registry sent a letter to the applicant requesting him to provide the Court with important factual developments, relevant to the communicated complaints. The letter further stated that the failure to reply by 9 March 2020 might lead the Court to conclude that the applicant was no longer interested in pursuing the application and would strike it out of its list of cases.

The applicant ’ s representative received this letter on the same date by e ‑ transmission. However, no response has been received.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
