FIRST SECTION
DECISION
Application no. 39535/15 Franjo MARTINOVIĆ against Croatia
The European Court of Human Rights (First Section), sitting on 9 July 2020 as a Committee composed of:
Krzysztof Wojtyczek, President, Linos-Alexandre Sicilianos, Armen Harutyunyan, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 3 August 2015 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Franjo Martinović , was born in 1941.
The applicant ’ s complaint under Article 6 § 1 of the Convention about the excessive length of civil proceedings was communicated to the Croatian Government (“the Government”).
By a letter dated 28 April 2020 the Government informed the Registry that the applicant had died on 30 November 2018 and enclosed his death certificate.
The Court notes that the applicant was not represented in the proceedings before it, that no heirs have presented themselves to pursue the application and that no information about any of the applicant ’ s relatives or other heirs could be discerned from the case-file.
THE LAW
In the light of the foregoing, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 30 July 2020 .
