Application no. 53520/16 Ion FERARU against Romania
The European Court of Human Rights (Fourth Section), sitting on 5 November 2020 as a Committee composed of:

Having regard to the above application lodged on 18 October 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Ion Feraru , was born in 1956.
The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).
On 4 February 2020 the Government informed the Registry that the applicant had died on 16 April 2019.
On 3 July 2020, the Registry sent a letter, by registered post, to the applicant ’ s address asking whether there was any potential heir wishing to pursue the proceedings before the Court.
On 20 July 2020, the letter was returned to the Court as “the sender is unknown and the address incomplete”. No potential heirs have presented themselves to the Court with a request to pursue the application.
THE LAW
In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
