Application no. 44955/16 Alexandru CUZA against Romania
The European Court of Human Rights (Fourth Section), sitting on 5 November 2020 as a Committee composed of:

and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 24 October 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Alexandru Cuza , was born in 1969.
The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).
On 20 January 2020 the Government informed the Registry that the applicant had died on 2 October 2019.
On 7 February 2020 and 8 July 2020 the Registry sent letters, by registered post, to the applicant ’ s home address, asking whether there was any potential heir wishing to pursue the proceedings before the Court.
On 21 July 2020 the applicant ’ s mother signed for the receipt of the last registered letter. However, no reply to this letter has been received by the Court to date.
THE LAW
In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
