FIFTH SECTION
DECISION
Application no. 27842/11 Valerian BALIASHVILI against Georgia
The European Court of Human Rights (Fifth Section), sitting on 21 January 2021 as a Committee composed of:
Ganna Yudkivska, President, Ivana Jelić , Arnfinn Bårdsen , judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 19 April 2011 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Valerian Baliashvili , was born in 1984.
The applicant was represented by Ms S. Abuladze, a lawyer practising in Tbilisi.
The applicant ’ s complaints under Articles 3, 6 and 13 of the Convention concerning the quality of medical care in prison and the lack of any effective remedy in domestic law were communicated to the Georgian Government (“the Government”).
On 6 November 2020 the Government informed the Registry that the applicant had died on 11 July 2018.
On 9 December 2020 the applicant ’ s representative informed the Registry that the applicant ’ s heirs did not wish to pursue the proceedings before the Court.
THE LAW
In the light of the foregoing, the Court concludes that the applicant ’ s heirs do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, it does not consider that respect for human rights as defined in the Convention and the Protocols requires the examination of the application despite the applicant ’ s death.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 11 February 2021 .
