DECISION

Application no. 32038/15 C.H. against Hungary

The European Court of Human Rights (First Section), sitting on 4 February 2021 as a Committee composed of:

Alena Poláčková , President, Péter Paczolay , Gilberto Felici , judges,

and Viktoriya Maradudina , Acting Deputy Section Registrar,

Having regard to the above application lodged on 22 June 2015 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr C.H., was born in 1983.

The Vice-President of the Section decided under Rule 47 § 4 of the Rules of Court to grant the applicant anonymity.

The applicant was represented by Ms B. Pohárnok, a lawyer practising in Budapest.

The applicant ’ s complaints under Article 5 § 1 of the Convention concerning the unlawfulness of his asylum detention, as well as under Article 5 § 4 of the Convention concerning the lack of any effective remedy to challenge its lawfulness were communicated to the Hungarian Government (“the Government”).

On 27 November 2020 the applicant informed the Registry that he wanted to withdraw the application to the Court since he was no longer interested in pursuing it.

THE LAW

In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
