DECISION

Application no. 78161/17 Hasan Hüseyin KARATAŞ against Turkey

The European Court of Human Rights (Second Section), sitting on 18 February 2021 as a Committee composed of:

Branko Lubarda , President, Carlo Ranzoni, Pauliine Koskelo , judges,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 31 October 2017 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Hasan Hüseyin Karataş , was born in 1960.

He was represented by Mr A. Aktay , a lawyer practising in Mersin.

The applicant ’ s complaints under Article 1 of Protocol No. 1 to the Convention concerning the judicial practice, in the context of expropriation proceedings, to order both parties to pay a lump sum to the opposing party in respect of lawyer fees, were communicated to the Turkish Government (“the Government”).

On 19 June 2020 the Government informed the Registry that the applicant had died before the introduction of the application before the Court and stated that his application should be struck out of the list of cases.

On 20 August 2020 the applicant ’ s representative informed the Court that the applicant had died after he authorised him to lodge the application with the Court. The applicant ’ s representative further stated that he had unsuccessfully attempted to reach the applicant ’ s heirs following the Government ’ s submissions.

THE LAW

In the light of the foregoing, the Court concludes that any potential heirs of the applicant do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
