DECISION

Application no. 43169/18 Aleksey Pavlovich PROVOROV and Gabriyel Eduardovich ARUTYUNOV against Russia

The European Court of Human Rights (Third Section), sitting on 25 March 2021 as a Committee composed of:

Darian Pavli, President, Dmitry Dedov , Peeter Roosma , judges,

and Liv Tigerstedt, Deputy Section Registrar,

Having regard to the above application lodged on 7 November 2018 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants, Mr Aleksey Pavlovich Provorov and Mr Gabriyel Eduardovich Arutyunov , are Russian nationals who were born in 1973 and 1978 respectively. They were represented by Ms T.A. Tretyak, a lawyer practising in Gelendzhik .

The applicants ’ complaints under Articles 3, 8 and 13 of the Convention concerning the conditions of their detention and transport, the permanent video surveillance of detainees in pre-trial or post-conviction detention facilities, their placement in a glass cabin during the court hearings and the lack of an effective remedy in that respect were communicated to the Russian Government (“the Government”).

On 5 January 2021 the applicants, who appear to have been released from detention, informed the Registry that they wanted to withdraw the application and discontinue the proceedings before the Court.

THE LAW

In the light of the foregoing, t he Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
