Application no. 30829/16 Ion STANCU against Romania
The European Court of Human Rights (Fourth Section), sitting on 17 June 2021 as a Committee composed of:
Armen Harutyunyan, President, Jolien Schukking , Ana Maria Guerra Martins, judges,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application lodged on 11 July 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Ion Stancu , was born in 1971.
The applicant ’ s complaints under Article 3 of the Convention concerning inadequate conditions of detention were communicated to the Romanian Government , who submitted observations on the admissibility and merits.
On 8 July 2020 these observations were forwarded to the applicant, who was invited to submit observations in reply. On 8 September 2020 the letter returned to the Court with the mention: “recipient deceased”.
On 10 December 2020 the Registry sent a letter to the applicant ’ s address asking whether there was a person who wished to pursue the proceedings on the behalf of the late applicant. No reply to this letter has been received by the Court .
THE LAW
In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
