The applicants are all Ukrainian nationals. They are all judges of the Poltava Regional Court of Appeal and reside in Poltava .

The facts of the case, as submitted by the applicants, may be summarised as follows.

In December 2001 the applicants lodged complaints with the Pechersky District Court of Kyiv against the Ministry of Finance and the State Treasury, seeking the recovery of salary arrears, life-t ime judicial benefits and compensation for the delay in their payment.

On 11 December 2001 the Pechersky District Court of Kyiv allowed the applicants ' claims. It also ordered the Ministry of Finance and the State Treasury to pay the applicants ' the following sums (in UAH):

On 26 February 2002 the Kyiv City Court of Appeal upheld this judgment in respect of the award of salary arrears to the applicants. It also remitted the case for fresh consideration in respect of the compensation for judicial benefits (medical treatment benefits). It therefore awarded the applicants the following lower sums:

In April 2002 the writs of execution were transferred to the Pechersky District Execution Service where the execution proceedings had commenced.

On 28 April 2003 the applicants informed the Court that the judgment given in their favour had not yet been enforced.

On 26 February 2004 the applicants received in full from the State Judicial Administration of Ukraine (the State body responsible for the financing of the courts ) the sums awarded to them by the judgment of the Pechersk y District Court of Kyiv on 11 December 2001, as amended by the ruling of the Kyiv City Court of Appeal of 26 February 2002.

On 2 April 2004 the applicants informed the Court that they no longer intend to pursue their application.

COMPLAINTS

The applicants complain about the non-execution of the judgment of the Pechersky District Court of Kyiv of 11 December 2001 . The applicants rely on Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention .

THE LAW

Notice of the application was given to the Government which submitted their observations on the admissibility and merits of the applicants ' complaints on 6 November 200 3 . On 31 March 2004 the Government informed the Court that the applicants ' complaints had been resolved at the domestic level. On 2 April 2004 the applicants requested the Court to strike the application out of the list of cases as the matter had been resolved at the domestic level and the State Judicial Administration had paid the sums awarded to them by the judgment of 11 December 2001 .

Having regard to Article 37 § 1 (a) of the Convention, the Court concludes that the applicant s do not intend to pursue the ir application. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its P rotocols which require the examination of this application to be continued. Accordingly, the application of Article 29 § 3 of the Convention to the case should also be discontinued.

For these reasons, the Court unanimously

Decides to strike the application out of its list of cases.
