SUBJECT MATTER OF THE CASE
The application concerns the cancellation of the applicant’s passport following his dismissal from his post as professor at Hacettepe University by Legislative Decree no. 672 published on 1 September 2016. He brought an action before the administrative court for the annulment of the administrative note preventing him from obtaining a new passport on the Passport Application System. The administrative courts dismissed his action and objection. The Constitutional Court declared his individual application inadmissible.
Referring, in particular, to the impossibility for him to attend meetings abroad organised by international professional associations, the applicant complained of a violation of Article 8 of the Convention on account of the cancellation of his passport and his inability to obtain a new passport.
QUESTION TO THE PARTIES
Has there been an interference with the applicant’s right to respect for his private life, within the meaning of Article 8 § 1 of the Convention by the cancellation of his passport and his inability to obtain a new passport? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2 (compare, mutadis mutandis , Telek and Others v. Türkiye , nos. 66763/17 and 2 others, §§ 101-128, 21 March 2023)?
