The European Court of Human Rights (Fifth Section), sitting on 14 September 2023 as a Committee composed of:

Having regard to the above application lodged on 9 April 2016,

Having regard to the observations submitted by the respondent Government and the observations in reply submitted by the applicant,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table.

The applicant was represented by Ms L.P. Bogutska, a lawyer practising in Odesa, Ukraine.

The applicant’s complaints under Article 6 § 1 of the Convention related to civil proceedings in which the applicant was a party were communicated to the Ukrainian Government (“the Government”).

THE LAW

In the present application, having examined all the material before it, the Court considers that for the reasons stated below, the applicant’s complaints are inadmissible.

In particular, the Court notes that the proceedings in the applicant’s case lasted for five years, six months and eighteen days before the courts of three instances and therefore could not be considered lengthy. Furthermore, the applicant had his case properly examined on the merits by the courts of three instances and their decisions are not unfair or manifestly unreasonable.

In view of the above, the Court finds that these complaints are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention.

For these reasons, the Court, unanimously,

Declares the application inadmissible.
