against Lithuania

The European Court of Human Rights (Second Section), sitting on 6 April 2023 as a Committee composed of:

Having regard to the above application lodged on 8 July 2019,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Gediminas Vaikšnoras, was born in 1982. He was represented by Mr L. Belevičius, a lawyer practising in Vilnius.

The applicant’s complaint under Article 5 § 3 of the Convention concerning the length of his detention on remand was communicated to the Lithuanian Government (“the Government”).

On 24 May 2021 the applicant informed the Registry that he wanted to withdraw the application to the Court. He stated that his complaint was based on the same facts and legal arguments as those which his co-accused had presented in the case Mikočiūnas and Others v. Lithuania ((dec.) [Committee], nos. 13394/18 and 2 others, 15 December 2020). Following the Court’s decision to declare the latter applications inadmissible, the applicant no longer saw any purpose in continuing the present proceedings.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
