SUBJECT MATTER OF THE CASE

In criminal proceedings against them, the applicants were held in a metal cage during the Baku Assize Court’s hearings (in particular the hearings of 3 and 10 February 2021), the Ganja Court of Appeal’s hearing of 4 February 2021 and the Khazar District Court’s hearing of 6 March 2021, respectively.

They complain under Article 3 of the Convention that their placement in a metal cage in the courtroom amounted to degrading treatment.

QUESTION TO THE PARTIES

1. Were the applicants subjected to treatment in breach of Article 3 of the Convention on account of their confinement in a metal cage in the courtroom (see, among other authorities, Svinarenko and Slyadnev v.
