SUBJECT MATTER OF THE CASE

The applicant is a single man who was appointed to act as a guardian of a five-year old girl left without parental care. Six years later his guardianship was temporarily suspended following a criminal suspicion. Regardless of the fact that no criminal behaviour has been revealed in his actions and that the institution of the criminal proceedings against him was refused, his guardianship over the child was subsequently withdrawn. The child was put in the State’s care.

QUESTIONS TO THE PARTIES

1. Has there been an interference with the applicant’s right to respect for his family life within the meaning of Article 8 § 1 of the Convention as a result of withdrawal of his guardianship over the child?

2. If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2 of the Convention?
