FIFTH SECTION
Application no. 31347/20 M.C.G. and Others against North Macedonia lodged on 16 July 2020 communicated on 8 December 2021
SUBJECT MATTER OF THE CASE
The applicants, a mother and her two minor daughters, relying on Article 3 of the Convention, complained that their husband and father, who had allegedly subjected them to bodily injuries and verbal insults, had not been held responsible by the authorities for his actions. Their criminal complaint of 9 January 2020 for domestic violence was rejected by two levels of prosecutors for lack of reasonable suspicion against the alleged perpetrator.
The applicants complain that the authorities did not investigate thoroughly their complaint of domestic violence.
QUESTIONS TO THE PARTIES
Having regard to the procedural protection from inhuman or degrading treatment, was the investigation in the present case in breach of Article 3 of the Convention? In particular, have the domestic authorities paid sufficient attention to the allegations of domestic violence inflicted on the applicants by their husband and father?
