FIRST SECTION
Application no. 12766/15 Konstantinos DEMERTZIS against Greece lodged on 27 February 2015 communicated on 15 December 2021
SUBJECT MATTER OF THE CASE
The application concerns the suspension of the applicant, a lawyer, following his appearance on a television programme about a child’s custody in his capacity of the father’s legal representative, pending the domestic examination of the case. He unsuccessfully challenged the disciplinary sanction before the Supreme Administrative Court. The final domestic decision no. 2577/2014 was issued on 17 July 2014. The applicant submitted a certificate of the Supreme Administrative Court attesting that it was finalised, and he could receive an official copy of it, on 23 September 2014.
The applicant complains that the imposition of the sanction breaches his rights under Article 10 of the Convention.
QUESTION TO THE PARTIES
Has there been a violation of the applicant’s right to freedom of expression to Article 10 of the Convention on account of the disciplinary sanction imposed on him following his appearance on a television programme of 6 March 2006 about a child’s custody in his capacity of the father’s legal representative (see mutatis mutandis Alfantakis v. Greece , no. 49330/07, 11 February 2010)?
