STATEMENT OF FACTS

THE FACTS

The first and second applicants are a couple who were born in 1964 and 1965, respectively. The third applicant is their son, born in 2000. They are Iraqi nationals who are currently in Sweden . They are represented before the Court by Mrs C. Skyfaros , a lawyer practising in Limhamn . The Swedish authorities have ordered their deportation back to Iraq .

COMPLAINTS

The applicants essentially complain under Article 3 of the Convention that, if they were deported from Sweden to Iraq , they would face a real risk of being killed by Al-Qaida members since the second applicant previously had collaborated with American companies and since the Iraqi authorities lack the possibility to protect them.

QUESTION

In the light of the applicants ’ claims and the documents which have been submitted, would they face a risk of being subjected to treatment in breach of Article 3 of the Convention if the deportation order to Iraq were enforced?
