Application no. 52911/12 Ionel RUSU against Romania lodged on 13 July 2012

STATEMENT OF FACTS

The applicant, Mr Ionel Rusu , is a Romanian national, who was born on 16 July 1976 and lives in Vaslui .

The facts of the case, as submitted by the applicant, may be summarised as follows.

The applicant was arrested on 17 February 2011. On 29 September 2011 the Bacău County Court sentenced him to six years ’ imprisonment. The decision became final on 5 July 2012 with the decision of the High Court of Cassation and Justice. He is currently serving his conviction in the Vaslui Penitentiary, after being transferred, betw een February 2011 and September 2012, to several other prisons, namely to Bacău , Rahova and Iaşi Penitentiaries. The exact dates of the transfers were not specified.

The applicant states that the conditions of his detention, before September 2012, were inhuman, because of the overcrowded cells, dirtiness and the lack of hygiene.

More precisely, he states that ( i ) he was detained in small and stifling rooms, where a number of more than thirty detainees were being kept together; (ii) he was stung by all kind o f insects such as lice and bugs ; and (iii) the daily food was under the normal standard of necessary calories .

He also alleged that such conditions aggravated his health because he contracted chronic diseases as gastritis, hepatitis and dyslipidaemia. He submits medical evidence to this respect.

COMPLAINT

By invoking Article 3 of the Convention, the applicant complains of the inhuman and degrading conditions of detention, as described above, in the Bacău , Rahova and Iaşi Penitentiaries.

1. Has the applicant been subject, in breach of Article 3 of the Convention, to inhuman or degrading treatment in the Bacău , Rahova and Iaşi Penitentiaries?

The Government are invited to provide information on the applicant ’ s detention conditions in the Bacău , Rahova and Iaşi Penitentiaries, in particular in connection with the cells where the applicant has been detained, stating particularly the number of beds and the number of persons being detained in the same cell with the applicant, but also the other material conditions of the cell, such as the size of the cell; the number and size of the windows; the sanitary installation available and the measures taken to ensure the hygiene in the cell especially against insects and any other form of parasites and infectious diseases.
