STATEMENT OF FACTS
The applicant, Mr Costel Ghimiși , is a Romanian national, who was born in 1960. He is currently serving a prison sentence in the Tȃrgu-Jiu Penitentiary .
The facts of the case, as submitted by the applicant, may be summarised as follows.
The applicant , sentenced on 28 September 2006 by the Bucharest District Court to five years and six months ’ imprisonment , is currently serving his conviction in the Tȃrgu-Jiu Penitentiary.
He states that the conditions of detention are inhuman and degrading due to overcrowding. He describes that between ninety to ninety-seven inmates have to share a cell of 91 square meters that is insufficiently ventilated and also that the areas for outdoor activities are very small taking into account the number of detainees: two areas of 50 square meters and one of 18 square meters.
He also refers to the poor hygiene, namely that there are only two bathrooms , that access to warm water is limited to 30 minutes/4 days per week and 1 hour/2 days per week for all the inmates , and that the cell is infested with lice and bugs and therefore the possibility to acquire several diseases is high.
He also states that there is no other furniture in the cell, that the personal assets are kept under the beds and that there are no shelves for the vessel.
COMPLAINT
The applicant complains under Article 3 of the Convention about the inhuman and degrading conditions of detention, as described above, in the Tȃrgu-Jiu Penitentiary.
QUESTIONS TO THE PARTIES
1. Has the applicant been subject, in breach of Article 3 of the Convention, to inhuman or degrading treatment in the Tȃrgu-Jiu Penitentiary?
2. The Government are invited to provide information on the applicant ’ s detention conditions in the Tȃrgu-Jiu Penitentiary, in particular in connection with the cells where the applicant has been detained, stating particularly the number of beds and the number of persons being detained in the same cell with the applicant, but also the other material conditions of detention , such as the size of the cell, the number and size of the windows, the sanitary installations available, the measures taken to ensure hygiene in the cells.
