STATEMENT OF FACTS

The applicant, Mr Güven Boğa , is a Turkish national, who was born in 1963 and lives in Adana . He is represented before the Court by Ms S. Aracı and Mr T. Bek , lawyers practising in Adana .

T he circumstances of the case

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 19 December 2010 the applicant attended the reading out of a press statement in Adana, protesting against the F-type prisons.

On an unspecified date, the Adana Governorship imposed on the applicant an administrative fine of 143 Turkish liras (approximately 60 Euros) for intentionally disobeying the orders issued by authorised bodies with the aim of protecting public order and safety pursuant to Article 32 of Law no. 5326.

On 2 May 2011 the Adana Magistrates ’ Court dismissed the applicant ’ s objection .

COMPLAINT

Invoking Article s 10 and 11 of the Convention, the applicant complain s that he was sentenced to an administrative fine on the grounds of attending the reading out of a press statement, which constituted a breach of his right to freedom of assembly .

QUESTION TO THE PARTIES

Has there been a violation of the a pplicant ’ s right to freedom of peaceful assembly , contrary to Article 11 of the Convention?
