Application no. 47861/13 Sorin CORCOMAN against Romania lodged on 18 July 2013

STATEMENT OF FACTS

1. The applicant, Mr Sorin Corcoman , is a Romanian national who was born in 1968 . He is represented before the Court by his brother, Mr R.P. Corcoman .

2. The facts of the case, as submitted by the applicant, may be summarised as follows.

3. On 8 February 2013 the High Court of Cassation and Justice finally convicted the applicant for cigarettes smuggling and conspiracy to commit crimes and sentenced him to five years imprisonment.

4. On 11 February 2013 the applicant started serving his sentence in the detention facilities of the TimiÈ™ County Police. He alleged that the detention conditions in these facilities were miserable: the beds were broken, no heating was provided, the food was of a very poor quality and scarce and there was a severe lack of hygiene and medical assistance. In addition, he also suffered from overcrowding.

5. On 14 February 2013 he applicant was moved to Timișoara Prison where he is currently serving his sentence. The applicant alleged that he was held in severe overcrowding, sharing a 15 sq. m room with other eight detainees in what he described as inhuman conditions. He alleged a total lack of ventilation or natural light, very poor hygiene conditions and very poor quality of food lacking entirely in meat, milk, fruits or sweets.

COMPLAINT

6. The applicant complains under Article 3 of the Convention about the material conditions of his detention in the facilities of the Timiș County Police and in Timișoara Prison, conditions which he considers to amount to inhuman and degrading treatment .

QUESTION TO THE PARTIES

Has the applicant been subjected to inhuman or degrading treatment, in breach of Article 3 of the Convention, on account of the conditions of his detention in the facilities of the Timiș County Police and in Timișoara Prison ?

The Government are invited to submit information concerning the conditions of the applicant ’ s detention in these detention facilities in particular as regards overcrowding, sanitary facilities, hygiene, the quality of food and of the medical assistance.
