STATEMENT OF FACTS
The applicant, Dmitriy Aleksandrovich Podgornyy , is a Russian national, who was born in 1974 and lived in the settlement of Myskhako in the Krasnodar Region until his arrest and conviction.
From an unknown date in 2008 to 22 June 2010 the applicant served the sentence in IK-12 (Russian designation ЯР-154/12), a correctional institution located in Volzhskiy of the Volgograd Region.
The dormitory in which the applicant slept was severely overcrowded. Thus, it was designed for up to 40 detainees, but actually hosted 168 inmates.
COMPLAINT
The applicant complains under Article 3 of the Convention about the conditions of detention in correctional colony IK-12.
QUESTIONS TO THE PARTIES
Were the conditions of the applicant ’ s detention in penitentiary facility IK ‑ 12 of the Volgograd Region (Russian designation ЯР-154/12) compatible with Article 3 of the Convention ? The parties are requested to answer the following questions:
(a) What were the dimensions of the dormitory where the applicant was held ? How many persons were detained in the dormitory simultaneously with the applicant?
(b) Was there adequate daylight in the dormitory?
(c) Was the ventilation system of the dormitory operating?
(d) Were there sufficient water taps and toilet pans in the dormitory to allow the detainees to comply with their sanitary needs when necessary?
(e) How many hours a day did the applicant spend inside and how many outside?
(f) What were the dimensions of the yard in which the applicant could walk?
